NEW DELHI, India – A Delhi court ordered two leaders of the youth-led Cockroach Janta Party (CJP) to five days of judicial custody on October 14 after police detained them for allegedly crossing barricades at Jantar Mantar, a prominent protest site recently removed from the list of officially designated demonstration venues.

Ashutosh Ranka and Saurav Das were detained on October 13 after entering the restricted area while carrying the Indian flag and raising slogans demanding the resignation of Chief Election Commissioner Gyanesh Kumar. Another CJP leader, Ajinkya Shinde, was released on a personal bond, according to reports from the proceedings.

Police accused the leaders of violating restrictions and breaching undertakings to maintain peace following earlier detentions. The case comes amid protests over India’s Special Intensive Revision (SIR) of electoral rolls, which opposition groups say risks removing eligible voters and could disproportionately affect communities opposed to Prime Minister Narendra Modi’s Bharatiya Janata Party (BJP).

The detention is not a conviction, and the allegations concerning the protest remain subject to legal proceedings. Separately, claims that electoral revisions were politically manipulated remain disputed.

Why the leaders were detained

Police said the activists entered Jantar Mantar after it had been removed from the list of designated protest sites. The reported charges include trespass, violation of prohibitory orders, breach of a peace bond and obstruction of a public servant.

Ranka and Das had previously been detained during protests in New Delhi and released after giving undertakings to maintain peace. Police argued that their latest actions indicated a risk of further violations if they were released, according to accounts of the court proceedings.

The court ordered five days of judicial custody, sending the two leaders to Tihar Jail. The exact reasoning and legal provisions in the written custody order could not be independently reviewed for this report.

CJP representatives disputed the police account and said the activists were demonstrating peacefully with the national flag and patriotic slogans. The party has described the detentions as an attempt to suppress dissent and said it intends to continue protesting.

Those assertions represent the party’s position. The central legal question is whether the activists violated the applicable restrictions and their earlier undertakings, not whether their political demands are legitimate.

Jantar Mantar removed as a designated protest venue

Jantar Mantar has long been associated with demonstrations in central New Delhi. Its removal from the list of officially designated protest locations has become another point of contention between authorities and activists.

Delhi Police Commissioner Anurag Kumar issued an order on October 11 designating Ramlila Maidan, Burari Ground and CBD Ground as venues for protests and demonstrations, according to published reports. Jantar Mantar was subsequently removed from the list of authorized sites.

The change does not, by itself, establish that all demonstrations in Delhi are prohibited. It changes the locations designated for permitted protests, and the terms of the police order determine the restrictions applicable at each site.

CJP members argue that moving demonstrations away from a central political area reduces their visibility. Authorities have cited public-order requirements in restricting access to the former protest site.

The balance between maintaining public order and protecting peaceful assembly remains an important civil-liberties issue. Assessing the legality of the restrictions requires the formal order and any relevant judicial rulings, neither of which was independently examined in full for this report.

Electoral-roll revisions fuel the protests

The CJP’s demonstration called for Kumar’s resignation over the Election Commission of India’s nationwide Special Intensive Revision of voter lists.

The revision aims to update electoral rolls, including by removing entries associated with deceased people, duplicate registrations and people who have moved or cannot be traced. The Election Commission has maintained that the process is intended to improve the accuracy of the rolls and that eligible voters whose names are missing can seek re-enrolment through the prescribed procedures.

Opposition parties and activists argue that the scale of the revisions, the documentation requirements and the process for restoring names could disenfranchise eligible voters. They have demanded greater transparency and safeguards against wrongful removal.

Reports published in October cited figures exceeding 130 million names removed from draft electoral rolls, including entries classified as deceased, relocated or untraceable. Those figures should not be interpreted as a confirmed count of eligible voters wrongly excluded. The categories refer to different reasons for non-inclusion, and their scope and reporting periods need to be checked against the Election Commission’s underlying state-level data.

The Election Commission’s voter services portal provides procedures for checking electoral-roll status and applying for registration. The availability of a re-enrolment process does not, on its own, establish how many people have been wrongly excluded or whether the process is equally accessible to all affected voters.

The BJP has rejected allegations that the revision is designed to benefit the governing party. No finding establishing politically directed manipulation of the voter lists was identified in the material reviewed for this report.

A dispute over accountability and public protest

The CJP began as a youth-led movement and has expanded its demonstrations to include grievances over employment, education and electoral accountability. Its campaign against the voter-list revision has become part of a broader opposition challenge to the Election Commission’s handling of the process.

The party’s demand that Kumar resign is a political call, not a finding of misconduct. Evaluating the underlying dispute requires evidence about the revision methodology, the treatment of disputed entries, the availability of appeals and the outcomes of any legal challenges.

The detention of Ranka and Das raises a separate question about how public-order powers are used when activists attempt to demonstrate at a location that authorities no longer recognize as an authorized protest venue.

Police say the leaders violated restrictions and previous undertakings. The party says the arrests punish peaceful political expression. Both positions should be assessed against the applicable orders, the court’s reasoning and any subsequent judicial review.

What remains unresolved

The five-day custody order establishes the immediate legal status of the two CJP leaders, but it does not determine their guilt. Their case remains separate from the substantive dispute over voter-list revisions.

The electoral controversy also remains unresolved. The figures cited in public reporting indicate a large-scale revision, but the number of entries removed is not equivalent to the number of eligible voters improperly excluded. Establishing the latter requires detailed evidence about the categories, verification procedures and access to correction mechanisms.

The next developments to watch are any challenge to the custody order, the court’s written reasoning, the application of the revised protest-site restrictions and further official data on the voter-roll process.

For now, the case illustrates how disputes over electoral accountability are intersecting with restrictions on public demonstrations in India. Whether the detentions withstand legal scrutiny, and whether the electoral revision adequately protects eligible voters, remain separate questions that require evidence rather than political claims alone.
