ISLAMABAD, Pakistan – President Asif Ali Zardari approved emergency measures in Khyber Pakhtunkhwa on October 11, suspending the provincial government led by jailed former Prime Minister Imran Khan’s Pakistan Tehreek-e-Insaf (PTI).

The decision transfers executive authority to the province’s federally appointed governor. The federal government says the move responds to rising militant violence and poor cooperation from the provincial administration.

PTI rejects that explanation. The party says the decision attacks its elected mandate. Khan’s spokesperson, Zulfiquar Bukhari, called it a “disguised coup.”

The decision deepens the conflict between Prime Minister Shehbaz Sharif’s government and PTI. It also comes as Khan’s supporters prepare to march toward Islamabad to demand his release.

Federal officials say they invoked Articles 232 and 234 of Pakistan’s Constitution. However, the government’s security claims and PTI’s political objections remain disputed. The legal validity of the measures also depends on whether the authorities followed the Constitution’s requirements.

Government Blames Provincial Administration for Security Failures

The federal cabinet recommended emergency measures after a meeting chaired by Sharif on October 11. The Prime Minister’s Office cited the worsening security situation and accused the PTI-led administration of “deliberate disengagement from the fight against terrorism.”

Zardari later approved the prime minister’s advice, according to government announcements.

Interior Minister Mohsin Naqvi and Law Minister Azam Nazeer Tarar accused provincial officials of failing to coordinate adequately with federal counterterrorism efforts. Tarar also said militant violence had increased in recent years.

Federal officials argue that disagreements and delays have weakened the response to attacks. However, the public announcements reviewed for this report did not independently establish that the provincial government caused the increase in violence.

The dispute follows weeks of tension over security policy and PTI’s planned protest march. Federal officials had urged Chief Minister Sohail Afridi to postpone the march, citing the risks associated with militant activity and large gatherings.

PTI disputes the government’s account. The party says it has faced political pressure from federal authorities and insists that voters gave it the right to govern the province.

What Pakistan’s Constitution Says

The government invoked two constitutional articles that serve different purposes.

Article 232 allows the president to proclaim an emergency under specified circumstances, including war, external aggression and internal disturbance.

Article 234 addresses situations in which a provincial government cannot function in accordance with the Constitution. It allows the president, under the article’s conditions, to assume certain provincial government functions or direct the governor to exercise them.

Article 234 also sets limits on how long the arrangement can continue. The proclamation must go before a joint sitting of Parliament. It expires after two months unless Parliament approves it.

Parliament can extend the arrangement through further resolutions, each covering no more than two months. Under the ordinary timetable in the article, the proclamation cannot remain in force for more than six months.

Tarar said the new arrangement would initially last six months. That statement describes the government’s intended duration, but it does not remove the requirement for parliamentary approval.

The Constitution also protects certain judicial powers. Article 234 does not allow the president to take over powers vested in a High Court or suspend the constitutional provisions relating to High Courts.

The official material reviewed for this report confirmed the announcement and the articles cited by the government. However, the signed proclamation and supporting documents were not available for examination. This means the exact wording of the order, the governor’s supporting report and all administrative provisions could not be independently verified.

The distinction is important: constitutional emergency rule is not automatically a military takeover. The announced measures place provincial functions under federal oversight through the governor. Whether the government met every constitutional requirement remains a separate legal question.

Governor to Take Over Provincial Functions

Tarar said Afridi’s provincial government had ceased to function under the new arrangement. Governor Faisal Karim Kundi would assume the relevant executive responsibilities, supported by an 11-member advisory council.

The government also announced plans to bring 12 districts under direct federal administration. Officials said a new secretariat would operate under the governor and the provincial chief secretary.

These measures represent a major change in how the province will be governed. Khyber Pakhtunkhwa was the only province controlled by PTI, making the suspension a significant political setback for Khan’s party.

However, the full administrative impact remains unclear. The government’s announcements describe the transfer of executive authority, but the available documents do not establish every consequence for provincial departments, officials or ongoing programmes.

The formal proclamations and related notifications will be important in determining the exact scope of the governor’s powers.

PTI Calls the Decision an Attack on Its Mandate

Bukhari condemned the suspension as a “disguised coup.” He argued that the move removed the last provincial government controlled by Khan’s party.

That description reflects PTI’s political position, not an established legal finding. The government announced the measures through a constitutional process, but that fact alone does not prove that it complied with every legal requirement.

PTI has also accused the federal government of pursuing Khan through politically motivated cases. Khan has been imprisoned since 2023 on corruption and other charges. He and his party say the cases are politically driven, while the government maintains that the proceedings follow judicial processes.

The dispute has roots in the political crisis that followed Khan’s removal as prime minister through a parliamentary no-confidence vote in 2022. Since then, PTI has continued to challenge the federal government’s legitimacy and its handling of cases involving Khan.

The competing accusations require evidence. PTI’s claims of political persecution do not, by themselves, establish the government’s motive. Similarly, federal allegations about the provincial administration’s security performance do not prove that the administration caused militant violence.

Detentions Reported Ahead of the March

Reports of detentions emerged around the emergency announcement. News reports said police had detained hundreds of PTI activists and three of Khan’s sisters ahead of the planned march.

The exact number of detainees, the grounds for their detention and their current status could not be independently confirmed through the official material reviewed for this report.

PTI also said Afridi and members of his former provincial cabinet had been detained. On October 12, Federal Information Minister Attaullah Tarar said Afridi was in “protective custody” and had not been arrested, according to a statement reported that day.

The distinction matters. “Protective custody” is the minister’s description of Afridi’s status. It does not independently establish the legal authority for holding him or resolve PTI’s account.

Police records, court documents or formal detention orders would help establish the legal basis for any detention. Without those records, the available evidence does not support treating every reported detention as confirmed or describing Afridi as formally arrested.

March to Islamabad Remains Uncertain

PTI organized the protest campaign to demand Khan’s release. The party had already delayed the march after negotiations with the federal government failed.

Afridi urged supporters to prepare for a march toward Islamabad. The campaign also involved marches through districts in Khyber Pakhtunkhwa. The suspension has now changed the political and administrative circumstances surrounding those plans.

Reports published after the announcement said demonstrators dispersed and daily life remained normal in parts of the province. The accounts reviewed did not report a large-scale protest following the decision.

That does not mean PTI has abandoned its campaign. The available information does not establish whether organizers will reschedule the march, change its route or continue with a different format.

Authorities had already placed barriers and increased security around key routes in Islamabad in anticipation of possible demonstrations. The emergency measures add another source of tension between the federal government and a party mobilizing supporters around Khan’s imprisonment.

The timing links the emergency declaration to the ongoing political standoff. However, the available evidence does not establish that stopping the march was the government’s proven motive for imposing emergency rule.

Militant Violence Fuels the Federal-Provincial Dispute

Khyber Pakhtunkhwa faces persistent security challenges along Pakistan’s border with Afghanistan. Pakistani authorities have blamed many attacks on Tehreek-e-Taliban Pakistan (TTP), an armed militant group distinct from the Afghan Taliban.

The two groups have links and a shared history, but they are not the same organization.

Islamabad has repeatedly accused Afghanistan’s Taliban authorities of providing sanctuary to TTP militants. Kabul has denied supporting the group. These competing claims form part of the wider security dispute between the two countries.

However, allegations about cross-border support do not establish responsibility for any specific attack. Each incident requires evidence about who carried it out and whether others helped plan or support it.

The federal government argues that counterterrorism operations require closer coordination between Islamabad and the provincial administration. PTI disputes the government’s account and says the intervention undermines provincial autonomy.

The emergency has turned that disagreement into a constitutional confrontation over who controls the province’s executive functions. Its consequences will depend on how the new administration operates, whether Parliament approves the proclamation and whether legal challenges follow.

For now, the federal government has announced a transfer of provincial executive powers, PTI has rejected the decision, and the march’s future remains uncertain. The available evidence does not establish that the intervention has resolved the security problems cited by officials or ended the political dispute.
